Due to the shortage of H1B quotas, any changes to the USCIS application for H1B are important for foreign students or professionals who want to apply for H1B immediately. The USCIS issued a new policy on March 5, 2007 to change the receipt of H1B status applications or H1B extension applications.
  
To apply for H1B status or H1B extension, applicants must fill out I-129 (Application H1B status) or I-539 (apply for H1B extension) Form. All applications can only be submitted to the Vermont USCIS Service Centre (Vermont Service Center) and forwarded to the local USCIS Service center by the Vermont USCIS Service Center, according to the previous application I-129 and I-539 forms. All application receipts will be sent to the applicant by the local USCIS service center. To optimize the process of processing applications within the USCIS, the new policy requires applicants to submit H1B status applications or H1B extension applications directly to the USCIS Service centre where they reside and work. The service center will send the application receipt to the applicant directly upon receipt of the application.
  
The USCIS has added the new policy to the I-129 form, and the new application Note will take effect from April 2, 2007 onwards. According to the new application instructions, all I-129 (H1B) applications need to be submitted to the California Immigration Services Center (California Service Centre) or the Vermont USCIS Service Center (Vermont Service Centre). If the H1B beneficiary's place of work is in several different places, the application should be submitted in accordance with the company's state to determine the USCIS service centre with jurisdiction. For example: Mr. Li is now working in California and separating, but New York State, when Mr. Li submits I-129 (H1B) application, he needs to submit the H1B application to New York State USCIS Service Center (Vermont Service Centre) with Vermont jurisdiction.
  
The USCIS will still accept I-129 (H1B) applications submitted to the Immigration Department from April 2, 2007 to 16th in accordance with the old application instructions. From April 17, 2007 onwards, all applications must be implemented in accordance with the new policy. All I-129 (H1B) applications submitted to USCIS under the old application instructions will be rejected by USCIS and will be returned to the applicant together with the application fee, application materials and new application instructions.
  
In recent years, quotas in each fiscal year have been exhausted in just a few weeks due to the shortage of H1B quotas. If this year's quota is exhausted in the short term, the employer can only apply for the next year's quota after April 1. The H1B quota for the financial year 2007 has not yet started in the financial year May 2006. If the U.S. immigration regulations do not modify the H1B quotas, then the 2008 fiscal year quota remains unchanged, except for the 6,800 countries left to the United States Free Trade Agreement, Singapore and Chile, only 58,200 quotas are left for other countries to apply. Therefore, many applicants who need to apply for H1B are prepared for the application before April 1. For them, this year the application must be carefully read the new I-129 (H1B) Application Note to ensure that the application is submitted to the correct USCIS service center. If the application is rejected for submission to the wrong USCIS service centre and needs to be re-applied, the beneficiary is likely to miss a limited quota, which will affect its legal status in the United States.
