Thunder infringement lawsuit wins

Yesterday morning, Thunder announced the latest developments in film copyright litigation with the Motion Picture Association of America. As the People's Court of Shanghai Pudong New Area made a decision without jurisdiction, it was determined that the lawsuit should be conducted in Nanshan district, Shenzhen, where the Thunder company's server was located, and the Motion Picture Association of the United States was prepared to withdraw the lawsuit, the first round of the confrontation between the two sides came to an end with Thunder's victory.

Because litigation between the two parties is closely related to the vital interests of the US film industry, as well as the future development of China's Internet download, search, content distribution, and other industries, it can even rise to a deeper level of Sino-US trade, the industry predicts that the Motion Picture Association of the United States will inevitably confront the Thunder infringement case in multiple rounds.

Motion Picture Association withdrawal

Luo Weimin, vice president of Thunder, told reporters yesterday that after a dispute with the Motion Picture Association of America on copyright in February this year, Thunder submitted the "application for objection to jurisdiction" and relevant evidence within the prescribed period. Then the people's court of Pudong New Area of Shanghai decided the case should be governed by the People's Court of Nanshan district of Shenzhen. "The Motion Picture Association of the United States was not prepared enough for this issue, and the letter of authorization was flawed. They withdrew the lawsuit on April 9, April ."

A Thunder representative revealed that since 2006, the Motion Picture Association of America has initiated more than 50 lawsuits in China, all of which have ended in winning or obtaining compensation, "because of the differences in the recognition of Internet infringement by courts in various regions, this case cannot be handled by the Shanghai court, and it is hopeless to win the game. Only in the most decent way can it be admitted as a failure, prepare to come back next time ". It is reported that 1/3 of the revenue of U.S. movies in mainland China is also from Shanghai. In the past, similar lawsuits in Shanghai mostly ended in the victory of the Motion Picture Association.

Thunder said "no responsibility should be taken"

As the differences between the two parties regarding Internet film infringement have not been resolved, the industry generally believes that the motion picture association will certainly collect evidence to make a comeback. Wang Yong, a lawyer on behalf of Thunder, said, "Thunder is not a content provider but a middlemen who provides Internet search. Thunder is incapable and has no obligation to identify whether content and user behavior constitute infringement, no responsibility for user infringement."

Luo Weimin said that the lawsuit in April fell short. Thunder once sent a willingness to negotiate and cooperate with the Motion Picture Association to discuss the possibility of cooperation on the release of genuine content. "But they did not respond, we only recommend that you do not announce the litigation results for the moment."

Yesterday, the reporter called Yu Jun, president of the Motion Picture Association of America. No one answered the call and sent an interview email to his Chinese contact. Reporter Huang Yu
