Microsoft accuses US customs of refusing to implement Motorola's mobile import ban

The US International Trade Commission ("ITC") last May ruled that its Motorola mobile phone products, which violate Microsoft's calendar program generation and synchronization patents, prohibit the importation of all infringing equipment into the US market. But according to Microsoft's Friday complaint in Washington, the import ban was not enforced.

Microsoft said in the complaint that after several discussions with Google, the U.S. Customs and Border Protection Agency continued to allow Motorola mobile phone products to enter the U.S. market, and Google has not previously targeted the ITC decision last year to make any changes to the functionality of the phone.

"U.S. Customs has a responsibility to implement the results of the ITC decision," said David Howard, Microsoft's deputy legal advisor, Reynolds. But the US Customs has repeatedly ignored its obligations and continued to allow Motorola Mobility to evade the ban after secret consultations. ”

Google response

"U.S. Customs has been right to reject Microsoft's actions, and the company is trying to expand the scope of the patent to prevent Americans from using a variety of legitimate calendar features on their phones, such as arranging meetings," said Matt Kalman, a Google spokesman, in a statement. ”

Jenny Burke, a spokeswoman for the US Customs, said the Jenny Bolk would not comment on the ongoing lawsuit.

In a complaint filed in Friday, Microsoft referred to U.S. Department of Homeland Security Minister Napolitano Janet Napolitano, who oversees U.S. customs.

Secret consultations

Microsoft's patented technology will expire in April 2018, and the ITC ban should have been in effect until now.

Microsoft said in the complaint that Google and the U.S. Customs had held several secret discussions in April this year. Microsoft knew nothing about it until June 24, when U.S. Customs decided to allow Motorola mobile phones to be imported into the U.S. market.

Microsoft said the U.S. Customs and Border Protection Agency had repeatedly allowed Motorola Mobility to evade the ban, according to a confidential business statement, but the customs has so far refused to share the document with Microsoft. ”
