Chapter II submission and delivery of documents

Article 4 The submission of domain name dispute case documents shall comply with the following principles:

(1) any documents transmitted by the domain name dispute resolution institution to either party must be transmitted simultaneously to the other party;

(2) documents transmitted by the expert group to either party must be simultaneously transmitted to the domain name dispute resolution agency and the other party;

(3) the document delivery party is obligated to keep records of the documents transmitted by it, so as to record the specific facts and circumstances of the transfer of the relevant documents for the relevant parties to consult and prepare relevant reports;

 

(4) when the party that delivers the document receives a notice and is notified that it has not received the file it delivers, or the party that delivers the file thinks that it has not successfully delivered the relevant file, the Party shall immediately notify the domain name dispute resolution institution of relevant information. Thereafter, the transfer and reply of any document shall follow the instructions of the domain name dispute resolution body;

(5) either party may notify the domain name dispute resolution agency to update its detailed contact information.
 
Article 5 The domain name dispute resolution institution has the responsibility to take effective measures to ensure that the respondent actually receives the complaint. After the respondent actually received the complaint or the domain name dispute resolution agency performed the following actions to enable the respondent to actually receive the complaint, the above responsibilities are deemed to be removed:

(1) all postal communications and fax addresses of domain name holders, management contacts, technical contacts, contractors, and payment contacts recorded in the domain name registration management institution and domain name registration service institution WHOIS database, send a complaint to the respondent;

 

(2) according to the email addresses of domain name holders, management contacts, technical contacts, contractors and payment contacts recorded in the domain name registration management institution and domain name registration service institution WHOIS database, or when the domain name corresponds to a website, an electronic complaint (including an attachment that can be delivered to the respondent in the relevant format) is sent to the respondent according to the e-mail address provided in the contact information of the website) of;


(3) according to the other mailing addresses selected by the respondent and notified the domain name dispute resolution institution, and, to the extent feasible, the claimant shall send a complaint to the respondent at all other addresses provided in accordance with Article 5.


Article 6 in addition to the circumstances specified in the previous article, any documents transmitted to or from the respondent in accordance with these rules shall be carried out in the manner specified by the complainant or the respondent. When the complainant or respondent does not specify the target, the following three methods are selected:

(1) transmission by fax with transmission confirmation;


(2) the postage is prepaid and sent by mail with a receipt or by post delivery;


(3) transfer a transfer record electronically over the network.

Article 7 any document submitted by the claimant and the respondent to the domain name dispute resolution agency or the expert group shall be submitted in accordance with the methods and methods (including the number of copies) stipulated in the supplementary rules of the domain name dispute resolution agency.


Article 8 unless otherwise agreed by the parties or otherwise decided by the expert group under special circumstances, the domain name dispute resolution procedure shall be in Chinese. The expert group may require the parties to submit all or part of the Chinese translations of any document not made in Chinese.

Article 9 unless otherwise specified in these rules or otherwise decided by the expert group, all documents stipulated in these rules shall be deemed to have been delivered in the following circumstances:


(1) if the email is sent by fax, the date displayed on the confirmation letter shall prevail;


(2) if it is sent by mail or by postal express delivery, the date recorded in the delivery receipt shall prevail;


(3) If the data is transmitted over the network and the transfer date is verifiable, the date shall prevail.

Article 10 unless otherwise specified in these rules, the start date of the period specified in these rules shall be the earliest date of delivery of documents presumed in accordance with the provisions of the previous article.
