Facts and reasons

The case of the applicant Li x× v. Jiang x× inheritance dispute was filed and held in court. The applicant claims that the wills established by the father of Jiang x× are valid during his lifetime, and the applicant can inherit the estate based on the shares determined by the wills. Witnesses Xu x× and Zhao x× are witnesses of the Oral wills established before Jiang x×'s father's death. They are the only persons who can prove the Wills and their contents.

Zhao x× has issued a witness statement to the court. However, Xu x× was hospitalized for sudden cerebral thrombosis recently and was diagnosed by a doctor. Because of the high severity of his illness, Xu x× may suffer from limb paralysis and language loss if cerebral thrombosis cannot be effectively controlled. In the event of the above circumstances, without being confirmed by Xu x×, it will make it difficult to identify the facts in this case.

Based on the above facts and reasons, the applicant deems that the evidence in this case is hard to be obtained. Therefore, the People's Court is requested to take evidence preservation measures to promptly investigate and obtain evidence from the witness Xu x×.
