The Delhi High Court this week passed an application from Ericsson to stop selling, promoting and manufacturing millet smartphones in India, according to the Times of India. Ericsson filed an application on the grounds that Millet violated Ericsson's standard core patent portfolio (SEP).
These sep patents are related to AMR, GSM and WCDMA communication technologies. India's Competition commission is investigating an earlier Micromax and Intex, the Indian mobile phone maker, who was sued by Ericsson for the same reason they were asked to pay Ericsson 1% of its sales revenue to obtain these patents.
However, the adoption of this application does not appear to have immediate legal effect. Millet in India's head Manu Jain in an interview with NDTV said:
Millet has not received a formal notice of the ban, our legal team is assessing the impact of the matter, we would like to negotiate with Ericsson.
The Indian Times reported that the millet choice previously ignored Ericsson's demand for patent licensing fees.
The Indian market is the most important part of the international planning of Millet, and it is also the main driving force to impact 100 million shipments next year.
