Recently, the Commission's digital Agenda Committee issued a bulletin entitled "Releasing cloud computing potential in Europe", announcing a new cloud computing strategy to promote the application of cloud computing in all areas and create plenty of jobs. To implement the strategy, the European Commission has set out a series of concrete measures aimed at creating 2.5 million new jobs in Europe by 2020 and producing 160 billion euros a year (accounting for 1% of EU GDP).

Cloud services challenge to personal replication tax

Different countries ' individual reproduction tax system becomes a big problem of transnational electronic commerce and a major obstacle to the establishment of digital single market.

The Cloud based content publishing model allows access and exchange of content from different devices and locations, which is what many consumers need. In this case, for the cloud services, the problem also follows: first, whether the need for a proper levy of personal reproduction tax, two, can upload or store in the cloud, three, can access the content through the cloud or the content can be personally copied.

The lack of coordination mechanisms and the lack of integration of new and old tax systems have had a negative impact on Europe's ICT and entertainment industries. At the same time, the economic interests of copyright holders have been lost because of the lack of policies governing cloud computing. Different countries ' individual reproduction tax system becomes a big problem of transnational electronic commerce and a major obstacle to the establishment of digital single market. In the personal reproduction tax system, it is very important that the development of new technology, especially cloud computing, should be taken into account in time.

With the advent of new business models, consumers should pay more attention to copyright rather than personal reproduction tax when accessing digital content in a legitimate way. This was also mentioned in Kretschmer's report to the UK Intellectual Property Office: "Personal copying is permissible if there is contract protection." The license fee is a reasonable compensation, the amount of the fee should be left to the market to decide. ”

In addition, the report entitled "Digital Opportunity" also indicates that there are many "cloud-based services" that are used only as backups, or for transmission of content to other devices, which is under the jurisdiction of the personal reproduction tax.

Fair and efficient transactions between copyright holders and cloud service providers, as well as between cloud service providers and consumers, are fair and effective compensation to copyright holders. At the same time, the European Commission needs to give due consideration to the new opportunities emerging from the new business model. These patterns both give birth to new ways of accessing content, and allow copyright holders to better manage their content and control the way they receive compensation.

Accessing content in the cloud

Cloud service providers are encouraged to provide multinational services that allow consumers to enjoy these services from different Member States.

In the European Union's single market for intellectual property, there is a prediction that the creation of a European framework for online copyright permits a large number of protected cultural products and services to be marketed in a legal manner. Modern licensing technology can provide more online services to users across Europe.

One is to establish a highly efficient and transparent management mechanism in cloud computing rights licensing and data management.

For cloud computing services and all online services, find solutions that make copyright licensing more efficient. The European Commission's recently enacted legislation will play a central role in overall management and simplify the process of applying for online music licences. This will improve access to online music and provide more online music.

The second is to encourage and support the development of automated and integrated standard management infrastructure projects.

The single market for intellectual property emphasizes that Europe should develop copyright licensing services and take into account network applications and tools to promote the development of cultural and creative industries and to make it easy and lawful for all members of the population to use and share published book materials and entertainment information.

Only if a licensing agreement is negotiated between the service provider and the copyright owner can the consumer legally consume content in the EU as a whole. The European Commission should also support Cross-border licensing agreements for these services and generate more revenue for copyright owners.

The existing legal framework for copyright is sufficient to deal with the issue of licensing in many countries. But the Commission should also introduce more innovative and flexible policies to deal with the licensing of copyrighted works in cloud computing services and introduce incentives for copyright owners to share their work in multiple countries. In addition, the European Commission will encourage cloud service providers to provide multinational services to consumers from different Member States.
