HTC, in a motion submitted to the US International Trade Commission ("ITC"), has withdrawn a key patent proposition for Apple, leaving only 2 patents on the standard elements involved.
HTC withdrew the U.S. patent, numbering 7,765,414, in a motion submitted to ITC. The patent relates to "the wiring and operation of the integrated interface of PDA and wireless communication systems". After that, HTC's patent claims against Apple in the lawsuit will be reduced from 8 to 2.
HTC filed a second claim with ITC in August 2011, accusing Apple of violating 7,765,414 and 2 other patents, and then adding 5 new patents in September. The new intellectual property was borrowed from Google (Weibo) but was vetoed by Thomas Pander (Thomas Pender) judge in June 2012. HTC subsequently appealed, but was dismissed by 6 members of ITC.
Apple filed a counterclaim in June this year against the alleged infringement of the 4G LTE standard element patent, accusing HTC of violating the Frand (fair, reasonable, non-discriminatory) principle. Florian Mueller, a patent blogger patents writer Florian Moulles, points out that if Apple's counterclaim on the Frand principle wins, HTC's second claim to ITC will fail. He also said that Apple's claim that the patent was invalid would also receive some support.
The 7,765,414 patent is one of HTC's only proprietary patents in the lawsuit, with other patents borrowed from Google and ADT. The case will be held in about one months.
