Oracle says H-P lured it to sign a settlement with fraud

But in a court document filed in Tuesday, Oracle claimed that Hewlett-Packard had used fraud to lure the company into signing a settlement that would be relevant to Mr. Hurd's disclosure of trade secrets.　　It was alleged that Hewlett-Packard had concealed plans for the CEO and chairman of Rey Lann, a former SAP executive, Leo Apotheker, and former Oracle executives. As Europe's software giant, SAP and Oracle are long-term rivals. Ryan was sacked by Oracle in 2000 and has a bad relationship with CEO Ellison (Larry Ellison). "Given the hostility between Oracle and Mr. Apotheker and Mr Ryan, HP understands that if Oracle learns about its personnel plans, it will not sign an agreement with Hurd," Oracle said in the paper. HP spokesman Merlin Mangalindan Mylene Mangalindan said HP was determined to force Oracle to live up to its commitment to HP and other customers. "Oracle is not focusing on the interests of its clients," he said in an e-mail, "instead of making excuses to cover up outright defaults." On the other hand, Oracle's accusations against Hewlett-Packard include libel and intentional interference in contractual relations.
