Hong Kong and Macao to set up a wholly-owned hospital in China next year

BEIJING, December 29 (Xinhua) The Ministry of Health, the Ministry of Commerce 29th issued the "Hong Kong and Macao service providers in the mainland to establish a wholly-owned hospital management interim measures" and "Taiwan(China) service providers in the mainland to establish a wholly-owned hospital management interim measures." At present, Hong Kong and Macao service providers in the mainland set up a wholly-owned hospital in Shanghai, Fujian province, Guangdong Province, Hainan Province and Chongqing Municipality. Taiwan(China)'s service providers have established wholly-owned hospitals in the mainland limited to Shanghai, Jiangsu, Fujian, Guangdong and Hainan Province provinces.  To promote closer economic cooperation between Hong Kong and Macao and the mainland, the Ministry of Health and the Ministry of Commerce have jointly formulated the two administrative interim measures. Administrative interim measures are clear, Hong Kong and Macao service providers, Taiwan(China) service providers are legally approved by the mainland (mainland) competent authorities, can be in the mainland (mainland) to establish a wholly-owned hospital.  The mainland (mainland) to the Taiwan(China)-Hong Kong-Taiwan(China)-owned hospitals adhere to the gradual opening up, risk-controllable principle, the legal protection of patients and the rights and interests of the service providers in Hongkong, Macao. Administrative interim measures clear, in the mainland (mainland) set up the Hong Kong-Macau-owned hospital, Taiwan(China)-funded hospitals, can choose their own business nature for profit or non-profit.  The establishment and development of the wholly-owned and wholly-owned hospitals in Hong Kong and Macao must conform to the planning of local medical institutions. Administrative interim measures, the establishment of the Hong Kong-Macau-owned hospital, Taiwan(China)-funded hospitals should meet the following conditions: Must be an independent legal person; The total investment of the tertiary hospital is not less than 50 million yuan, the total investment of the second class hospital is not less than 20 million yuan;  In the old, small, edge, poor areas set up Hong Kong-Macau-owned hospitals, Taiwan(China)-funded hospitals, the total investment requirements can be appropriately reduced. Administrative interim measures pointed out that the application for the establishment of Hong Kong-Macau-owned hospital, Taiwan(China)-funded hospitals, should be the location of the district's municipal health administrative departments to apply. The Municipal Health Administrative Department of the District shall examine the materials submitted by the applicant, and the provincial health administrative departments shall review the application materials and the opinions of the first instance and submit their opinions to the Ministry of Health for approval. The Ministry of Health shall, within 20 working days from the date of acceptance, make a written decision which is approved or not approved.  The applicant who applies for the establishment of a for-profit hospital shall, after obtaining the permission from the Ministry of Health, apply to the Ministry of Commerce in accordance with the provisions of relevant laws and regulations.  Administrative interim measures, the approved establishment of the Hong Kong-Macau-owned hospital, Taiwan(China)-funded hospitals, should be issued by the Ministry of Commerce "Foreign Investment Enterprise approval certificate" from the date of one months, with this certificate to the relevant departments for registration formalities.  The verification period of "Medical institution practising license" of the wholly-owned hospital of Hong Kong and Macao is 3 years, and the verification of the medical institution practising license shall be handled by the medical institution's practising registration organ. The above two interim measures have been implemented since January 1, 2011.
