Lehman asked to investigate Barclays

On the evening of May 19, Beijing time, lawyers for Lehman Brothers asked bankruptcy court judges to allow them to investigate Barclays PLC (BCS) in Britain.  The British bank scrambled to buy its securities department at the start of Lehman Brothers ' bankruptcy. In documents submitted to the court, Lehman said Barclays had not fully fulfilled its obligations and might have paid less than billions of dollars to Lehman Brothers.  Lehman asked for the right to investigate Barclays Capital.  A Barclays spokesman said there was no comment on the matter. Lehman's plan to sell its core assets was approved by the court last September. It was just less than a week before Lehman filed for bankruptcy protection with the court.  The collapse of Lehman became the largest bankruptcy in U.S. history.  Lehman claimed that the Barclays proposal was the only viable option, and that the company had to do so as soon as the value of its brokerage/dealer unit shrank at $ millions of a day. To buy Lehman's sector, which includes Lehman's Manhattan headquarters, Barclays paid 250 million of billions of dollars in cash and was asked to pay some of its staff costs and bear some other debt.  The firm has since realised that there is a clear gap between the debt that Barclays has incurred and the benefits Lehman has gained, according to Lehman. Lehman specifically identified gaps in employee bonuses, contract liquidated damages and part of the asset-transfer plans associated with repurchase transactions.  The debtor usually has to pay a certain amount of liquidated damages when he abandons the contract. James Peck, a U.S. Bankruptcy court judge, will rule on the request on June 3.
