Third, the mainland enterprises in Taiwan to invest or set up a non-legal person, should carefully understand and abide by local laws and regulations, respect for customs and habits, pay attention to environmental protection, to do the necessary social responsibility. The Ministry of Commerce, in accordance with the measures for the administration of Foreign Investment (Ministry of Commerce Order 5th of 2009), is responsible for the approval of investment in Taiwan or the establishment of non-legal persons. The local enterprises shall apply to the Ministry of Commerce by the provincial Department of Commerce, and the central enterprise should apply to the Ministry of Commerce. When the provincial Department of Commerce or the central enterprise makes an application for approval to the Ministry of Commerce, the Ministry of Commerce shall, after soliciting the advice of the Taiwan Affairs Office of the State Council, approve the measures for the administration of overseas investment. After the mainland enterprises have been authorized to invest or establish a non-legal entity in Taiwan, the Ministry of Commerce issues the certificate of Enterprise's overseas investment or the certificate of the enterprise's overseas institution. Mainland enterprises are required by the "Enterprise Overseas Investment Certificate" or "Enterprise overseas institutions Certificate" to handle the approval formalities and foreign exchange and other related formalities. The mainland enterprises shall carry out relevant business in strict accordance with the scope of business approved by the Ministry of Commerce. After the local registration of enterprises or non-legal persons incorporated in Taiwan, Mainland enterprises shall report the relevant registration documents to the Ministry of Commerce and the Taiwan Affairs Office of the State Council for filing within 15 working days. In the case of changes and termination of enterprises or non-legal entities which have been invested and established in Taiwan, the relevant formalities shall be handled in accordance with the measures for the administration of overseas investment. The Ministry of Commerce and the Taiwan Affairs Office of the State Council shall supervise and inspect the investment of mainland enterprises in Taiwan or the establishment of non-legal persons. The Ministry of Commerce, in conjunction with the Taiwan Affairs Office of the State Council, shall punish the mainland enterprises for investing in or establishing non-legal persons in Taiwan in violation of relevant regulations.
