One-time worker's death grant is 20 times times per capita income

The revised bill expands the scope of work injury identification and increases the standard of one-time worker's death grant and one-time disability benefit.　　The standard of one-time worker's death subsidy is 20 times times of the disposable income per capita in the last year. The Industrial Injury Insurance Ordinance has been implemented since January 2004. The general meeting of the State Council was convened to make relevant changes to the new situation and problems faced by the industrial injury insurance system.　　The revised bill has perfected the relevant system from the standpoint of safeguarding the lawful rights and interests of workers.　　The revised draft expands the scope of the application of industrial injury insurance, in addition to the existing provisions of enterprises and self-employed employees, not in reference to civil service Law management institutions, social groups, as well as private non-enterprise units, foundations, law firms, accounting firms and other organizations should also participate in industrial injury insurance.　　The revised draft expands the scope of work injury identification in the commute, in accordance with the provisions, in addition to the current provisions of motor vehicle accidents, workers in the commute from the main responsibility of non-motor vehicle traffic accidents or urban rail transit, passenger ferry, train accident injury, should also be identified as injury. In order to simplify work injury identification, identification and dispute handling procedures, the draft stipulates that for the fact that clear, right and obligation of a clear application for injury, should be determined within 15th.　　At the same time, the time limit of re identification and reexamination is clarified, and the prior procedure of administrative reconsideration is cancelled.　　According to the bill, the lump-sum disability benefit is increased by 1-3 months ' wages to the employee in accordance with the current compensation standard. The cost of injury prevention is added as the fund expenditure item, the one-time work injury medical benefit paid by the employing unit, the hospitalization expenses subsidy and the transportation and accommodation fees required for medical treatment outside the co-ordination area shall be paid by the fund.　　At the same time, the draft increases the penalties for uninsured units and strengthens the rights and interests of workers injured in the uninsured units. The current regulations stipulate that the standard of the one-time workers ' death grant is the monthly average wage of the workers in the area of 48 months to 60 months. The specific standards by the Government of the co-ordination region according to local economic and social development conditions, reported to provinces, autonomous regions, municipalities directly under the central government for the record.　　The revised draft stipulates that the standard for one-time workers ' death grants is 20 times times the annual disposable income of the country's urban residents. According to this provision, the death subsidy will be unified as the national disposable income of urban residents, avoid the existing provisions by the local government to account for themselves. According to the reporter, the revised grant is 4-5 times the original provision, assuming that the standard is equivalent.
