According to the information released by the China Patent Reexamination Board, more than 30 pieces of patent invalidation applications have been accepted, and more invalid proceedings are expected to be accepted subsequently. In addition to China, ZTE lawsuits against vringo in Germany, the United Kingdom, Australia and other countries have also been accepted or are pending.
In addition to launching a patent-neutral lawsuit worldwide, ZTE also filed an antitrust investigation against Vringo in the EU. "We have no choice. To launch such a tough crackdown is not our original intention." ZTE official said that in the past two years involved in the negotiations conducted by both parties and has been committed to friendly consultation with the solution to Vringo's Patent disputes. Vringo, however, insisted on its apparently unreasonably high licensing fee and continued litigating ZTE in multiple countries to pressure ZTE to accept its unfair patent licensing conditions by disrupting ZTE's normal market operations. Vringo's conduct has violated the principle of fairness, reasonableness and non-discrimination set by ETSI. It also violates antitrust laws of EU and other countries and seriously damages the interests of ZTE and its customers.
ZTE stressed that it should respect the legitimate patent claims of other manufacturers and has always solved the intellectual property disputes in the telecommunications industry through cross-licensing and package agreements in an open and win-win manner. At present, it has reached a wide range of consensus with Qualcomm, Siemens, Ericsson and Microsoft, and signed dozens of cross-licensing agreements on global intellectual property rights.
