Linus Torvalds is not prepared to come to an early conclusion on the SCO legal proceedings against IBM before the pending Unix code case has been written into court.
  
In an email to CRN, Mr. Torvalds, who is recognized as the father of Linux, said he would always wait for the verdict, until SCO clarified the so-called IBM theft and delivered Unix code to the open source community.
  
But at this point, he said that he was skeptical about the significance of the case.
  
Torvalds wrote in his letter: "SCO didn't even state what they own, and I am not a lawyer. People I 've talked about seem to think that the truth about the case lies in the details, and SCO hasn't revealed any details yet, so they cannot say anything ." Torvalds wrote that he could not see the "conclusive evidence" on the Linux code issue and he did not think IBM was responsible for the dispute.
  
"I have not seen what IBM has done wrong, except what I have heard so far. I just imagined it as a common business case. When SCO can't get anything in the market, it's just a matter of making a complaint about the idea of the rich investors ." SCO officials insisted that the lawsuit against IBM in March had legal significance, but refused to comment on the code case under consideration.
  
IBM, as the other party, in its response to this lawsuit in April 30, totally denies all the allegations against it by SCO. SCO officials said they have not decided when to hear the case.
  
Some observers, especially those in the Linux camp, speculate that SCO intends to reach a fast settlement with IBM. Others said it was seeking to locate itself or Unix System V assets.
  
A person close to SCO confirmed that IBM lawyers are "discussing possible discussions" with SCO's legal team ." For the SCO side, company officials insist that their legal requirements are justified and valid, and that they will understand the code in court.
  
At least one full-time intellectual property lawyer said he did not consider the case to be of judicial value and IBM may block further delays in the case.
