This article mainly divides into five parts to study the patent protection of cloud computing: first, clear the research background and research method of the patent protection of cloud computing, use the method of literature research, investigation analysis and comparative study to unfold the exposition scientifically and systematically; second, to examine the basic theory of cloud computing and its related patents, Service forms, key technologies, the general context of the development and the basic principles of patent rights, the conditions of the grant to comb; Thirdly, the paper analyzes the challenge of cloud computing to the traditional patent protection, proposes the attribute of the patented part in cloud computing, through the development of business method patent and the way of China's commercial method This paper analyzes the patentability and substantive requirements of cloud computing business methods, and expounds the negative reasons for the patentability of cloud computing rules. Four, discusses the cloud computing domain patent protection, because the cloud computing and the traditional patent law has the certain conflict to the patent protection way, therefore, in to its patent protection process, needs to use the patent law the relevant stipulation flexibly, broadens the patent protection scope, clear patent each party's benefit.
