Three months ago, the non-profit Linux organization LinuxTag e. v. tarent GmbH, an IT consulting company, filed a lawsuit with a district court in Munich, Germany, request the court to stop SCO from claiming that Linux open source has infringed its intellectual property rights without providing any evidence. The court finally approved the litigation requests of LinuxTag e. V. and Tarent GmbH. LinuxTag spokesman Andre goberhad said that after the Munich court issued a verdict, SCO was banned from issuing a statement about Linux source code infringement of its intellectual property rights in Germany.
In May March, SCO initiated a $3 billion lawsuit against IBM, claiming that IBM does not properly provide source code for Linux operating systems, in addition, the Linux system also contains code copied from the source code of the Unix V system, which is almost the same as the code in the V system. But SCO has been criticized by the industry for failing to provide evidence about Linux source code infringement of its intellectual property rights. Two weeks ago, SCO took out two so-called illegal codes as evidence at its "SCO Forum-User Conference", but these two codes were quickly separated by Linux organizations, linux organizations believe that these two sections of code are valid.
According to SCO spokesman blackstorville, SCO closed its website in Germany in early June in order to remove information that is inconsistent with the court's decision, however, he ignored an article titled "A Letter to SCO partners" on his German website, which caused the company to be fined 10000 euros. Although this article has been deleted, SCO has published similar articles on its Web site in the United States. According to stoville, SCO is currently making an appeal against the above penalty.
