Canonical developers announced last week that the forthcoming Ubuntu 16.04 LTS Xenial Xerus will support Oracle/Sun's ZFS file system. Software Freedom Conservancy (SFC) published an article saying that Canonical's plan to support ZFS would infringe on the kernel's GPLv2 license. The ZFS file system uses the CDDL license, which is incompatible with the GPLv2 license used by the Linux kernel. Canonical conducted a legal evaluation prior to making a decision to support ZFS and held that the support for ZFS would not violate the GPLv2 license on the grounds that zfs. ko is a self-contained file system module. The kernel is not a derivative of ZFS file system, but zfs is an independent module. ko is not a derivative of the kernel either. SFC objected to this explanation and held that the release of zfs. ko violates the GPL license.
