"I personally think that the war between proprietary and open-source software has become a thing of the past," he said ."

"In the end, we are responsible to our customers and our shareholders to ensure that our intellectual property rights are respected," he said ."

Microsoft has repeatedly mentioned that Linux has broken many Microsoft patents, but Microsoft has never sued a company.

Gutierrez said he would rather leave the record blank. He also said that the agreement between Microsoft and Novell is a demonstration that the two competitors can cooperate and eventually achieve a win-win situation.

He said that Microsoft has been looking for methods to negotiate with its opponents five years ago to solve software use authorization problems. He pointed out that prior to the widespread use of software patents, companies were cautious about sharing any technical details, and companies were very careful about their intellectual property secrets.

However, patents are a double-edged sword for Microsoft. Gutierrez revealed that at present, Microsoft has handled 50 patent litigation cases, accounting for half of Microsoft's total lawsuit.
