Mofcom: 95% Antitrust review cases passed without conditions

Earlier, antitrust scrutiny of the widespread involvement of foreign companies has sparked concern among some foreign companies. Shang Ming the statement at a special press conference on antitrust work held by the Ministry of Commerce yesterday. According to his introduction, as at the end of June 2010, the Ministry of Commerce has filed a total of more than 140 antitrust cases, of which 4 declarations after the initiative to withdraw.  90% of cases have been concluded, 95% cases have been examined unconditionally, 5 cases have imposed restrictive conditions, and one case is prohibited, namely Coca-Cola's takeover of Huiyuan. Shang Ming said that the review of antitrust cases, including the rejection of most of the case involving foreign companies, is only a superficial phenomenon. On the one hand, the transnational corporations are abundant in funds, because the threshold of declaration is the scope of the operators ' concentration, while the proportion of multinational corporations to the threshold is higher. On the other hand, although the financial crisis has a certain negative impact on mergers and acquisitions, but after the financial crisis, multinational mergers and acquisitions active.  Shang Ming said, in fact, the Ministry of Commerce as far as possible to take care of the requirements of the reporting party mergers and acquisitions, such as Panasonic mergers and acquisitions, the Ministry of Commerce in the context of restrictive conditions, only to impact on the competition of a certain business, the entire acquisition activity has not had a negative impact. The anti-monopoly Law of China has been in effect since August 1, 2008. According to the rules: all participating enterprises in the global turnover of 10 billion yuan, and at least two enterprises in China's turnover of more than 4 billion yuan, or participate in the concentration of enterprises in China turnover of more than 2 billion yuan, at least two enterprises to reach more than 400 million yuan mergers and acquisitions need to declare anti-monopoly review.
