First, in China, the legal basis for intellectual property protection is mainly based on the copyright law, patent law, and anti-Unfair Competition Law. The Copyright Law protects the work itself. For computer software, the problem involved is the display effect of the user interface. What is displayed on the screen is legally the same as what is displayed on the paper. Therefore, the screen display interface is protected by copyright.
However, for graphic elements such as icons, if they are more practical than artistic, they will not be protected by copyright; if they are more practical than practical, they will be protected by copyright. Therefore, it is a violation of copyright law to deliberately imitate the appearance of a completely identical screen interface. However, if the screen interface is similar and more practical than the aesthetics, it does not violate the Copyright Law.
Patent protection is a technical solution, a method to achieve a certain goal, rather than the result of this goal. For example, "Save As Doc document format" does not violate the patent law, but if a technical solution used to achieve the "Save As Doc document" function violates the patent, it is not allowed.
