Two high judicial interpretations clear the boundaries of cyber-prosecution and libel

September 9, a spokesman for the Supreme People's Court, Jungong, said today that even if some of the contents of the investigation and disclosure were untrue, it should not be prosecuted for criminal prosecution if it was not deliberately fabricated to slander others, or if it was spread on the information network without knowingly fabricating the facts of the reputation of others.

The Supreme People's Court and the Supreme People's Procuratorate jointly held a press conference today to announce judicial explanations on criminal cases such as defamation of information networks. This judicial interpretation will be implemented on September 10, 2013.

Sun military pointed out that at present, the vast number of netizens use information network for "Network anti-corruption", "micro-bo anti-corruption", for anti-corruption work played an active role. The majority of Internet users through the information network to prosecute, to expose other violations of law and discipline, the relevant departments should be taken seriously, responsible verification, timely publication of the results of the investigation.

Sun military stressed that even if the prosecution, the disclosure of part of the content is untrue, as long as it is not deliberately fabricating facts to slander others, or is not known to be fabricated to damage the reputation of other people in the information network spread, should not be prosecuted for criminal liability.
